A Santa Clara woman filed a personal injury lawsuit in Los Angeles Superior Court for personal injury against Dynasty Nails, a salon located on Boquet Canyon Road. The woman, Sonia Algara, claimed that the substandard pedicure causes her toe infection, which was later amputated to stop the spreading of infection. She said that on March 15, 2015, she went to the Salon and paid $20 for a pedicure, as stated in a Los Angeles CBS news report.
What Causes Unsanitary Conditions At A Nail Salon
Unsanitary conditions in nail salons are often caused by employees who are not properly trained. Some are not up to par with the standards that other nail salons and spas have set. Some common causes of unsanitary conditions include:
- Reusing tools without sterilizing them.
- Reusing tools that are porous and cannot be sterilized.
- Recycling foot bathwater.
- Using inferior products.
- Cutting corners to save money.
Far too often, a nail salon will try to sacrifice safety for the sake of increasing its bottom line. Nail salon injuries can have far-reaching impacts not only for clients but for those around them, as well. No matter the cause, they are endangering themselves, their clients, and the general public and should be held responsible for their actions.

For Proper Instrument Sterilization A Device Called An Autoclave Is The Only Safe Bet
While many salons use Barbicide, UV light sterilizer boxes, or other chemical solutions to disinfect their tools, the only device that works completely to sterilize instruments is called an autoclave, which uses high pressure and steam to kills 100 percent of all infective organisms. But currently, only two states require autoclaves in nail salons by law, which means that less than one percent of salons use them regularly.
To be safe, according to NYCs best Nail Salon Attorney, the customer should ask the salon owner/manager if they use an autoclave to disinfect their tools. Then customers should look for the color change pouches that the instruments are prepared in. The color changes on the bag once correct sterilization conditions have been met. This color change indicates that the object inside the package has been sterilized. Autoclave pouches are sealed and the customer should ask for them to be opened in front of them.
A Warning To The General Public About The Potential Of Nail Salon Personal Injury
This particular salon, which is the subject of a lawsuit, was reviewed on Yelp with a three and a half star rating around the time of the complaint. Clients should be aware on the following concerns when choosing a nail salon:

- Always ask questions as to the salon procedures and the products they are using.
- Be observant on how the salon attendant performs the tasks, so as to be confident that everything is done with extra care.

Woman Gets Pedicure Loses Toe Sues Nail Salon
SANTA CLARITA —A woman is suing a Santa Clarita nail salon claiming a botched pedicure gave her an infection, causing her to eventually lose a toe.
CBS Los Angeles reports that Sonia Algara filed the lawsuit Monday in Los Angeles Superior Court against Dynasty Nails.
The plaintiff said she went to the salon on Bouquet Canyon Road for a pedicure on March 15, 2015.
An employee used a pair of scissors to cut in between the plaintiff’s fourth and fifth toe on her left foot, according to the suit.
“The incision caused severe pain and infection and eventually led to the pinky toe needing to be amputated” within a week, the lawsuit stated.”
“She has some pain. They stopped right there. She then goes to the hospital, finds out that there’s an infection,” said the plaintiff’s attorney Daniel Rafii.
He said his client is diabetic and had warned the salon that she carries a greater risk of infection.
The lawyer said Algara visited a nearby hospital that same day. But a week later, doctors had no choice but to remove her toe.
Algara said the disfigurement has affected her balance, ability to wear certain shoes and left her unable to walk up stairs.
She is seeking unspecified damages for her medical expenses, mental anguish and emotional distress.
Dynasy Nails has many positive reviews on Yelp. CBS2/KCAL9’s Rebecca Ferriter tried to contact salon owner for comment but has not heard back.
When Is The Nail Salon Responsible
A bad haircut or uneven spray tan may be unsatisfactory service, but these arent reasons to file an insurance claim or lawsuit. Most of the time, a dissatisfied customer can speak to the salon owner for a full refund or account credit.
Customers who suffer verified injuries due to the negligence of the salon owner or staff are eligible to seek compensation from the salons insurance company.
Whether you are filing a premises liability claim after a slip and fall, or a claim for injury related to a salon service, youll have to prove the salon was responsible for your injury.
Every beauty salon has a duty of care, meaning the salon must take reasonable steps to protect clients and guests from harm.
It helps to understand some legal terms used by lawyers and insurance companies:
Foreseeability means the salon owner knew or should have known about the potential for harm. For example, allowing an untrained employee to give a chemical peel facial. The salon owner knew or should have known that improper training might result in injury to a customer.
Negligence means the salon service provider did something wrong or failed to do what a competent provider would do. For example, failing to cover a customers eyes while applying chemical peel products to the face.
Damages are the financial consequences of your injuries. Damages include medical and therapy bills, out-of-pocket expenses, lost wages, and pain and suffering.
